This website and online store are operated by Bricknic BV, a company registered in the Netherlands under KVK number 86862057 and VAT number NL864121106B01.

Throughout these Terms of Service, “Bricknic,” “we,” “us” and “our” refer to Bricknic BV. “You” and “customer” refer to any visitor to our website or purchaser of our products.

Bricknic offers this website, including all information, tools, products and services available through it, subject to your acceptance of these Terms of Service and the policies referenced within them.

By placing an order through our online store, you agree to these Terms of Service. Please read them carefully before completing a purchase.

Nothing in these Terms limits or excludes any mandatory consumer rights granted under applicable law.

Our online store is hosted by Shopify. Shopify provides the e-commerce platform that enables us to offer and sell our products.

3. Eligibility and lawful use

You must be legally capable of entering into a purchase agreement in your country of residence.

You may not use our website, products or services for any unlawful, fraudulent or unauthorised purpose.

You may not transmit viruses, malicious code or any other material that could damage, interrupt or interfere with the operation or security of the website.

We may restrict or terminate access to our website when we reasonably believe that these Terms have been violated.

4. Product information

We make reasonable efforts to ensure that product descriptions, specifications, prices, images and availability information are accurate and current.

Because Bricknic products are manufactured using ceramic materials and production processes, minor variations in colour, glaze, texture, dimensions and surface appearance may occur. These natural variations do not necessarily constitute a defect.

Colours may also appear differently depending on the screen or device used to view the website.

Product images are provided for illustrative purposes. Unless explicitly stated otherwise, accessories, food, decorations and other products shown in lifestyle images are not included.

We reserve the right to correct errors or inaccuracies and to update product information where necessary.

5. Product use and safety

Bricknic products must be used in accordance with the instructions, care guidance and safety information supplied with the product or published on our website.

Customers are responsible for:

• Reading the product instructions before use

• Using the product only with suitable heat sources

• Following the stated temperature and handling guidance

• Protecting surfaces against heat where necessary

• Keeping hot products away from children

• Avoiding sudden temperature changes that could cause thermal shock

• Checking the product for visible damage before use

Ceramic products may become extremely hot during cooking. Appropriate heat-resistant protection must always be used.

Bricknic is not responsible for damage caused by misuse, failure to follow the instructions, unsuitable heat sources, thermal shock, improper storage or unauthorised modification of a product.

This does not affect liability that cannot legally be excluded or limited.

6. Prices and taxes

Product prices are displayed in the currency applicable to the selected market.

Unless stated otherwise, prices for customers within the European Union include applicable VAT.

Shipping costs are not included in the product price unless explicitly stated. The available shipping methods and costs are displayed during checkout before the purchase is completed.

Orders delivered outside the European Union may be subject to import duties, customs charges and local taxes. Unless explicitly stated otherwise during checkout, these costs are not included in the product price or shipping charge and must be paid by the customer.

We may change prices at any time. Price changes do not affect orders that have already been accepted.

7. Orders

After placing an order, you will receive an electronic confirmation that we have received it. This confirmation does not necessarily mean that the order has been accepted.

We reserve the right to refuse or cancel an order for legitimate reasons, including:

• A product being unavailable

• An obvious pricing or product-information error

• Suspected fraud or unauthorised payment

• An incomplete or invalid delivery address

• Legal or shipping restrictions

• Orders that appear to be intended for unauthorised resale

• Quantities exceeding available stock or reasonable household use

If we cancel an order after payment has been received, the relevant amount will be refunded using the original payment method.

A purchase agreement is concluded when we confirm that the order has been accepted or dispatched, subject to mandatory applicable law.

8. Customer information

You agree to provide accurate and complete order, billing, delivery and contact information.

You are responsible for checking the information provided before completing the order.

Please contact us immediately at info@bricknic.org if you notice an error. We cannot guarantee that order or address information can be changed after dispatch.

We may contact you using the email address or telephone number supplied with the order when necessary to process or deliver it.

9. Payment

Available payment methods are displayed during checkout.

Payment must be successfully authorised before an order can be processed. Payment services may be provided by Shopify or other independent payment providers.

We do not store complete payment-card information on our own systems.

If a payment is rejected, reversed or identified as potentially fraudulent, we may suspend or cancel the order.

10. Shipping and delivery

Orders are normally prepared and dispatched within two working days after successful payment.

Orders are shipped from our warehouse in Belgium.

Bricknic ships worldwide, except to the Netherlands, Belgium, Luxembourg, Germany and Austria. Customers in these countries should purchase from the appropriate local Bricknic distributor.

Shipping costs are calculated automatically during checkout based on the destination, weight and size of the order.

Available shipping methods, estimated delivery times and applicable costs are displayed before the purchase is completed.

Delivery times are estimates and cannot be guaranteed. Customs processes, carrier delays, public holidays, weather conditions and other circumstances outside our reasonable control may affect delivery.

11. Risk during delivery

For consumer purchases, responsibility for the products passes to the customer when the products are physically received by the customer or a person designated by the customer, unless applicable law provides otherwise.

Please inspect the order shortly after delivery.

If a package or product arrives damaged, contact us as soon as possible at info@bricknic.org and provide:

• Your order number

• A description of the damage

• Clear photographs of the product

• Photographs of the interior and exterior packaging

• A photograph of the shipping label

Please keep the damaged product and packaging until the claim has been assessed.

12. Right of withdrawal and returns

Consumers within the European Union generally have the right to withdraw from an online purchase within 14 days without providing a reason.

For products, the 14-day period normally begins on the day the customer, or a person designated by the customer, receives the order.

To exercise the right of withdrawal, contact us at info@bricknic.org within the applicable period and clearly state that you wish to withdraw from the purchase.

For ordinary returns under the right of withdrawal, the customer is responsible for the direct return shipping costs.

Products should be returned securely packaged, complete and without damage beyond what is necessary to inspect their nature, characteristics and functioning.

Discounted products remain covered by mandatory statutory consumer rights.

Some products, including products made to the customer’s specifications or clearly personalised, may be excluded from the right of withdrawal where permitted by law.

13. Refunds

If a return is accepted, the applicable refund will be issued using the original payment method.

We may withhold the refund until we have received the returned products or until the customer provides evidence that the products have been returned, whichever occurs first.

Refund processing times may vary depending on the payment provider or bank.

For valid EU withdrawals, reimbursement of the original standard delivery cost will be handled in accordance with applicable consumer law. Additional costs resulting from the customer selecting a more expensive shipping method than our standard option may not be refunded.

14. Defective, damaged or incorrect products

If a product is defective, damaged during delivery or different from the product ordered, contact us at info@bricknic.orgas soon as possible.

After assessing the issue, Bricknic will arrange an appropriate solution, such as repair, replacement, price reduction or refund, in accordance with applicable consumer law.

Bricknic will cover reasonable shipping costs associated with returning or replacing a confirmed defective, damaged or incorrect product.

Nothing in these Terms limits applicable rights concerning product conformity, product safety or statutory guarantees.

15. Intellectual property

All content available through the website, including product designs, photographs, videos, text, graphics, logos, trademarks, recipes, manuals and other materials, is owned by or licensed to Bricknic unless stated otherwise.

You may use the website and its content only for personal and non-commercial purposes.

You may not reproduce, modify, distribute, publish, sell, license or commercially exploit any website content without prior written permission from Bricknic or the relevant rights holder.

16. Reviews, comments and submissions

If you submit a product review, photograph, comment, suggestion or other content, you confirm that:

• You have the right to submit the content

• The content is accurate and not misleading

• The content does not violate any intellectual property, privacy or other legal rights

• The content is not unlawful, abusive, discriminatory or harmful

• The content does not contain malicious software or unsolicited advertising

You grant Bricknic a non-exclusive, worldwide and royalty-free licence to display, reproduce and use content that you voluntarily submit for publication in connection with Bricknic’s website, products and marketing.

We may remove submitted content when we reasonably believe it violates these Terms or applicable law.

Personal information contained in submissions will be handled in accordance with our Privacy Policy.

17. Third-party services and links

Our website may contain links to third-party websites or provide access to services operated by third parties, including payment providers, carriers and social-media platforms.

Third-party services are governed by the terms and privacy policies of the relevant provider.

Bricknic is not responsible for the content, availability or independent practices of third-party websites. This does not limit any responsibility Bricknic has for services used to fulfil its obligations to customers.

18. Privacy

The collection and processing of personal information through our online store are governed by our Privacy Policy.

The Privacy Policy is available through the footer of our website.

19. Website availability

We aim to keep the website accurate, secure and available, but we cannot guarantee uninterrupted or error-free access.

We may temporarily suspend, update or modify parts of the website for maintenance, security or operational reasons.

We are not responsible for temporary unavailability caused by circumstances outside our reasonable control.

20. Liability

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

Bricknic remains responsible for fulfilling its legal obligations concerning product conformity, defective products, statutory guarantees and product safety.

To the maximum extent permitted by law, Bricknic is not liable for indirect or consequential losses that were not reasonably foreseeable when the purchase agreement was concluded.

Bricknic is not liable for damage resulting from improper use, failure to follow product instructions, unsuitable heat sources, thermal shock, improper storage or unauthorised modification of a product.

This section does not affect any mandatory consumer rights.

21. Indemnification

To the extent permitted by law, users acting for business or commercial purposes agree to compensate Bricknic for reasonable losses, claims or expenses resulting from their unlawful use of the website, infringement of third-party rights or material breach of these Terms.

This provision does not apply where its application would unfairly limit mandatory consumer rights.

22. Severability

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be applied to the maximum extent permitted by law or removed where necessary.

The remaining provisions will continue to be valid and enforceable.

23. No waiver

If Bricknic does not immediately enforce a provision of these Terms, this does not mean that Bricknic has waived its right to enforce that provision later.

24. Governing law and disputes

These Terms and purchase agreements concluded through this online store are governed by the laws of the Netherlands.

If you are a consumer residing in another country, this choice of law does not deprive you of any mandatory consumer protection granted by the laws of your country of residence.

Any dispute will be handled by a court with jurisdiction under applicable law.

Before starting formal proceedings, customers are encouraged to contact us at info@bricknic.org so that we can attempt to resolve the matter directly.

25. Changes to these Terms

We may update these Terms when necessary to reflect changes to our services, business operations or legal obligations.

The version applicable to an order is the version in effect when that order is placed.
